2. Application method

Applicants can send an E-mail to the address specified in the announcement. Please be sure to specify the name of the project involved in the bidding, the full name of the applicant, and the registered capital of the enterprise, as well as the participating brand (OEM or agent), and information of contact person, including name, contact telephone number and e-mail address. At the same time, such information shall be affixed with an official seal (any application with incomplete information shall be deemed to be invalid).

3. Time and place of bid opening

Place of bid opening: Power Building of Guangxi Yuchai Machinery Co., Ltd.

Deadline for submission of bids: 9:00 a.m. on June 22, 2022.

Proposed time of bid opening: 9:00 a.m. on June 22, 2022 (tentative).

The bidding documents delivered after the deadline for submission of bids will be rejected, and the documents submitted within the specified time that do not meet the requirements of relevant regulations will also be rejected. During bid opening, the legal representative or authorized representative of the bidder shall attend the bid opening ceremony.

After the application deadline, if the number of bidders is less than 3, the bid will be regarded as a failed bid.

The bidders shall respond to the relevant provisions of the Tenderee's contract, agreement for safety and environmental protection management responsibility, and integrity agreement templates. Any bidders failing to respond will be regarded as not meeting the requirements of the bidding documents, and their bids will be rejected.

VI. Payment Method

For details, please refer to the Annex Bidding Documents for the Crane Project of R&D Center of Guangxi Yuchai Marine and Genset Power Co., Ltd. and Instructions to Bidders (hereinafter referred to as the "Instructions to Bidders").

Part II: Instructions to Bidders

I. Requirements for basic conditions of bidders

1. The bidders shall comply with the provisions of Article 26 of the Law of the People's Republic of China on Tenders and Bids.

2. The bidders shall have the right to conclude contracts and the ability to perform contracts independently, and have business qualification certificates according to law.

3. The bidders shall possess the status of a legal person.

4. The bidders shall be general VAT taxpayers, and shall have no records of violations of laws in other activities of bidding for procurement in the past three years.

5. The bidders shall have a good business reputation, a sound financial and accounting system, and good financial status and market behavior, and shall not be in a state of revocation of business license, revocation of qualification, suspension of business for internal rectification, property receivership, freezing or bankruptcy. The products provided by the bidders shall have no major quality problems during use in the past three years.

6. The bidders shall not be in a state of trading disqualification by Guangxi Yuchai Machinery Co., Ltd. and Guangxi Yuchai Marine and Genset Power Co., Ltd. due to breach of contract, integrity or other reasons.

II. Other conditions stipulated by applicable laws and regulations

III. The bids submitted by the bidders shall be prepared on the basis of a full understanding of all the information provided by the Tenderee. If the bidders have submitted their bids, the Tenderee will consider that the bidders have fully understood all the factors affecting the project implementation cost in the bids, and will confirm that the bidders have made corresponding considerations in the commercial proposal. In this case, any adjustment to the commercial price and any additional costs proposed by the bidders thereafter will not be accepted by the Tenderee.

IV. If any requirements specified in the Instructions to Bidders cannot be met, the bidders must clearly state them in the bids. If there are requirements in the Instructions to Bidders, while no statement is made in the bids submitted by the bidders, the bidders will be deemed to fully respond to these requirements. In this case, any statement for negative deviation from these requirements proposed by the bidders after bid evaluation will no longer be accepted by the Tenderee.

V. Confidentiality

The parties participating in the bidding shall keep confidential the business and technology in the bidding documents and the bids, and any party in violation of the requirement shall bear legal responsibility for the consequences caused thereby.

VII. Miscellaneous

1. The bidders shall make a payment of CNY 30,000 as the bid bond according to the notice of the Tenderee. For the successful bidder, the bid bond will be converted into the performance bond (without interest). For the unsuccessful bidders, the bid bond will be returned within 2 months after bid evaluation.

The bidders shall, no later than 48 hours before the bid opening, remit the bid bond to the account of Guangxi Yuchai Marine and Genset Power Co., Ltd. through the public account:

2. The bid bond will not be refunded in any of the following cases:

(1) The bidder withdraws the bid within the validity period of bids;

(2) After receiving the letter of acceptance, the successful bidder fails to sign the contract with the Tenderee without any justifiable reasons, puts forward additional conditions to the Tenderee at the time of signing the contract, or fails to submit the performance bond in accordance with the requirements of the Bidding Documents;

(3) The bidder disturbs the order of bid evaluation; or

(4) The bidder is involved in collusive bidding, frauds or any other illegal behaviors.

3. The Tenderee has the right to disqualify any bidder who disturbs the on-site order of bid evaluation.

4. If the successful bidder wins the bid by other fraudulent means or fails to sign the contract after winning the bid, the successful bidder will be disqualified. In this case, the Tenderee will not return the bid bond, and the bidder will not be allowed to participate in the Tenderee's any activities of bidding for procurement within three years. At the same time, the Tenderee has the right to choose another successful bidder.

5. The bids will not be returned. Instead, they will be reasonably disposed of by the Tenderee on the premise of fulfilling the obligation of confidentiality.

6. The Tenderee reserves the right of final interpretation of the Bidding Documents of the Project.
