YCMGP: Iron Fist for Cracking Down on Counterfeits The Verdict of the First Criminal Case of Counterfeiting Yuchai Registered Trademarks

In recent days, Kunming Intermediate People’s Court has made a verdict on the criminal case in which an electromechanical equipment company in Yunnan manufactured and sold diesel engine with counterfeit Yuchai registered trademark. Li, the actual controller, has been sentenced to three years in prison (with three years of probation) and fined RMB 350,000 for counterfeiting a registered trademark. The verdict is beyond a severe punishment for Li's infringement and counterfeiting, it is also a strong deterrent to such acts.

Li bought some second-hand "Yuchai" diesel engines at a low price from 2020 to 2022. After refurbishing engines and adding forged nameplates with Yuchai's registered trademark (to counterfeit the model and power), he sold engines and made huge profits, and the value of diesel engines involved in this case is nearly RMB 700,000. In July 2023, YCMGP's special group

against counterfeiting, together with external anti-counterfeiting companies, reported clues to the local public security authorities, and orderly promoted relevant judicial authorities for case filing and investigation, examination and adjudication, and investigated Li's criminal and legal responsibilities in accordance with relevant laws.

The success has consolidated YCMGP's confidence and determination to crack down on infringement and counterfeiting. The YCMGP's special group against counterfeiting will maintain a tough stance and continue to strengthen the coordination across different levels, uphold internal and external coordination, and comprehensively employ administrative complaints, civil claims as well as criminal reports to carry out in-depth and persistent anti-counterfeiting campaigns to protect rights, ensure Yuchai's brand image, purify the market, and provide strong support for the company's high-quality development.
